KenyaExpat - Terms & Conditions

These Terms & Conditions govern all relocation and concierge services provided by KenyaExpat.
By engaging our services, the Client agrees to the terms outlined below regarding the collection of personal information, service delivery, and client responsibilities.
————————
1. Information Sharing & Consent

The Client voluntarily provides personal information, including but not limited to name, email, phone/WhatsApp number, housing and relocation preferences, and supporting documents (“Personal Data”). The Client consents to the collection, storage, and use of this Personal Data by the service provider for the purpose of delivering relocation services.

2. Third-Party Services

The Client acknowledges that the consultant may share Personal Data with trusted third parties (including landlords, schools, healthcare providers, and service providers) strictly as necessary to fulfill relocation services. The contractor is not responsible for the performance, pricing, quality, or outcomes of third-party services.

3. Communication

The Client authorizes the service provider to contact them by email, phone, or messaging platforms regarding relocation services, updates, and related opportunities.

4. Data Security

The contractor will take reasonable measures to protect the Client’s Personal Data. However, the Client acknowledges that no system is entirely secure, and the operator shall not be liable for unauthorized access or use of Personal Data beyond its reasonable control.

Proceeding with payment or written confirmation shall constitute acceptance of these Terms & Conditions.

5. Service Limitations & Liability

-
The independent consultant acts solely as a facilitator and advisor. Responsibility for decisions (e.g., housing leases, school enrollments, healthcare choices) rests with the Client.

-
To the maximum extent permitted by law, the contractor shall not be held liable for any indirect, incidental, or consequential damages, including financial loss, delays, or dissatisfaction with third-party services.

-
All payments must be made in full before commencement of services, unless otherwise agreed in writing. The service provider reserves the right to suspend services for late or incomplete payments.

-
Payments made for service providers are non-refundable once the service has been initiated, except where required by applicable law.

6. Withdrawal of Consent

The Client may request in writing to withdraw consent for the storage or use of Personal Data. However, such withdrawal will not affect services already delivered or legal obligations already undertaken.

7. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with Kenyan laws.

Any disputes arising under this Agreement shall first be resolved through good faith negotiation. If no resolution is reached, the dispute shall be referred to mediation before either party may initiate legal proceedings.

8. Acknowledgment
By signing, the client confirms that they have read, understood, and agreed to this agreement and its terms.
